What does a Hague Apostille authenticate? What a Hague Apostille authenticates

A Hague Apostille is a certificate attached to a public document that confirms three specific things: the authenticity of the signature of the person who signed the document, the capacity in which that person acted (the position they hold), and the identity of the seal or stamp on the document. It does not assess whether the content of the document is true: it only confirms that the document came from who it says it came from.

Who can use the Apostille: member countries

The Apostille only has effect between countries that signed the 1961 Hague Convention Abolishing the Requirement of Legalisation for Foreign Public Documents. Brazil joined the Convention in 2016, and the United States has been a member since 1981. Between these two countries, the Apostille replaces a longer and more bureaucratic consular legalization process.

Apostille vs. certified translation: not the same thing

The Apostille authenticates the origin of the document in its original language. A certified translation guarantees that the translated version is faithful to the original text. They are complementary processes, not substitutes: a Brazilian document for use in the US often needs both, the Apostille on the original document (or on a certified copy of it) and then a certified translation into English.

What the Apostille does not do

The Apostille does not verify whether the information in the document is true, does not correct errors in the original document, and does not replace other specific requirements of whoever will receive the document, such as additional notarization or translation. It specifically solves the question of the formal authenticity of the document between the two countries.

Who issues the Apostille

Each member country designates its own competent authorities to issue the Apostille. In Brazil, these are the notary offices (cartórios) authorized by the CNJ; in the United States, usually the Secretary of State of each state, or the federal Department of State for federal documents. The right authority depends on where the document was originally issued.
